    Terms of Use

    1. Acceptance of Terms

    By accessing and using the AREA Uganda website ("the Site"), you agree to be bound by these Terms of Use, our Privacy Policy, and all applicable laws and regulations of the Republic of Uganda, including the Computer Misuse Act, 2011, the Electronic Transactions Act, 2011, and the Data Protection and Privacy Act, 2019. If you do not agree with any of these terms, you must not use the Site.

    2. Definitions

    • "AREA Uganda" refers to the Association of Real Estate Agents Uganda
    • "Member" refers to any individual or entity that has an active membership with AREA Uganda
    • "User" refers to any person accessing or using the Site
    • "Services" refers to all features and functionalities provided through the Site

    3. Membership

    Membership with AREA Uganda is subject to application, payment of applicable dues, and approval. By applying for membership, you:

    • Confirm that all information provided is accurate and complete
    • Agree to pay the membership fees associated with your selected tier
    • Consent to your professional details being displayed in the member directory
    • Agree to abide by AREA Uganda's code of professional conduct and ethics
    • Understand that membership may be revoked for violation of these terms or professional misconduct

    4. User Accounts

    You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify AREA Uganda of any unauthorised use of your account. AREA Uganda shall not be liable for any loss arising from your failure to safeguard your login information.

    5. Payments and Refunds

    All membership dues and event fees are processed through IOTEC Pay via MTN Mobile Money or Airtel Money. By initiating a payment:

    • You authorise the deduction of the specified amount from your mobile money account
    • You acknowledge that payment processing is handled by third-party providers subject to their terms
    • Membership fees are non-refundable unless AREA Uganda, at its sole discretion, determines otherwise
    • Failed or disputed transactions should be reported to ceo@areauganda.org within 14 days

    6. Intellectual Property

    All content on this Site — including text, graphics, logos, images, and software — is the property of AREA Uganda or its licensors and is protected under Ugandan intellectual property laws and international treaties. You may not reproduce, distribute, modify, or create derivative works from any content without prior written consent from AREA Uganda.

    7. Acceptable Use

    You agree not to:

    • Use the Site for any unlawful purpose or in violation of Ugandan law
    • Attempt to gain unauthorised access to any part of the Site, its servers, or connected systems
    • Upload or transmit viruses, malware, or other harmful code
    • Impersonate another person or misrepresent your affiliation with any entity
    • Scrape, harvest, or collect data from the Site without authorisation
    • Use the member directory for unsolicited marketing or spam

    Violations may result in immediate account termination and referral to relevant Ugandan authorities under the Computer Misuse Act, 2011.

    8. Member Directory

    The member directory is provided as a professional resource. Listed members consent to having their professional information displayed. Information from the directory must not be used for purposes unrelated to legitimate real estate business inquiries. AREA Uganda reserves the right to remove any listing at its discretion.

    9. Content and Events

    AREA Uganda publishes news, articles, and event information for informational purposes. While we strive for accuracy, we do not guarantee that all content is complete, current, or error-free. Event details, dates, and locations are subject to change. Registration for events is subject to availability and any additional terms specified for each event.

    10. Limitation of Liability

    To the fullest extent permitted by Ugandan law, AREA Uganda shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services. Our total liability for any claim shall not exceed the membership fees paid by you in the 12 months preceding the claim.

    11. Indemnification

    You agree to indemnify and hold harmless AREA Uganda, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

    12. Data Protection

    Your personal data is processed in accordance with our Privacy Policy and the Data Protection and Privacy Act, 2019. By using the Site, you acknowledge and consent to the collection and processing of your data as described in our Privacy Policy.

    13. Dispute Resolution

    Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to mediation under the Centre for Arbitration and Dispute Resolution (CADER) in Kampala, Uganda. These Terms are governed by and construed in accordance with the laws of the Republic of Uganda.

    14. Modifications

    AREA Uganda reserves the right to modify these Terms at any time. Changes take effect upon posting to the Site. Continued use of the Site after modifications constitutes acceptance of the updated Terms. Material changes will be communicated to registered members via email.
